BARKS Terms of Use
Please read the following terms of use (hereinafter referred to as the “Terms of Use”) before using the BARKS website operated by BARKS Co. By using BARKS, you agree to be bound by these Terms of Use and any other terms and conditions separately established by the Company. These Terms of Use apply to all users of BARKS.


Notice Concerning Attribution of Copyrights, Trademarks, etc.
All rights to all information provided by us, including BARKS, belong to us or to the original right holders who have granted us permission to use such information (hereinafter referred to as “original right holders”). All rights to the design of BARKS, as well as all rights to the logos and trademarks displayed on BARKS, also belong to us or the Original Rights Holder. Registered Members and Guests may not use any information provided through BARKS in any way outside the scope of personal use permitted by copyright law without the permission of the Company or the Original Rights Holder.


Disclaimer
In order to keep BARKS in good working condition, we may discontinue providing all or part of BARKS at any time.


1. for routine and emergency maintenance of the system
2. when system operation becomes difficult due to fire, power outage, sabotage by a third party, etc.
3. other cases in which we deem it necessary to suspend the system

BARKS is provided free of charge, and we shall not be liable for any loss or damage arising from the unavailability of BARKS. In no event shall the Company be liable for any damage, loss, or disadvantage arising out of or in connection with the use of BARKS, regardless of the legal cause of action.
In the event that a user causes damage to a third party by using BARKS, the user shall resolve the problem at the user’s own responsibility and expense and shall not cause any inconvenience or damage to the Company.


Miscellaneous
The Company reserves the right to change the contents of BARKS services and pages without prior notice. The Company may also change the Terms of Use and other terms and conditions separately stipulated by the Company.


If any problem arises in connection with the use of BARKS that cannot be resolved by these Terms of Use or by the Company’s instructions, the Company and the User shall discuss and resolve the problem in good faith between the Company and the User. The Tokyo District Court shall be the court of exclusive jurisdiction in the first instance.
